1. Scope
These terms apply when you use the Kaistone website and when you purchase or use Kaistone's digital service. By creating an account, completing a purchase, or using the service, you accept these terms.
2. Account and eligibility
- You are responsible for ensuring that the information you provide is accurate and up to date.
- You are responsible for protecting your login credentials and for all activity that occurs through your account.
- You may not share an account in a way that conflicts with your plan or agreed licence terms.
3. Orders and agreement
- Purchases can be made via the website or via quote and invoice.
- The agreement is considered entered into when Kaistone confirms the order or when the service is made available to you.
- Plans, prices, and scope may be set out in a price list, quote, or separate agreement.
4. The service and delivery
- The service generates reports based on analyses of a URL and related content.
- Once an analysis has been started, it cannot be undone or changed.
- Results are advisory. The service may use automated methods and AI, which means errors and incompleteness may occur.
5. Prices, payment, and invoicing
- Current prices are set out on the website, price list, quote, or separate agreement. Prices are stated exclusive of VAT unless otherwise stated.
- Invoicing may occur monthly. Payment may be made by invoice and may also be offered by card.
- In the event of late payment, default interest will be charged in accordance with the Swedish Interest Act, as well as reasonable reminder and collection fees.
- Kaistone may adjust prices ahead of a new period or ahead of the next renewal, and will notify you of this in reasonable time.
6. Refunds and complaints
- No refund is provided for an analysis that has been started or completed.
- If you believe the service was not delivered as agreed, contact Kaistone promptly so we can investigate and remedy.
7. Permitted use
You may use the service for legitimate business purposes and in accordance with applicable law and these terms.
7.1 Prohibited use
- Attempting to circumvent security, access controls, or restrictions in the service.
- Using the service in a way that disrupts or damages the operation, performance, or other customers' use.
- Copying, decompiling, or attempting to reconstruct the service's source code, models, or logic.
- Creating competing products based on the service or the structure and content of reports.
- Editing report content and then presenting it as a Kaistone report.
8. Intellectual property
- Kaistone owns all rights to the website, service, methods, templates, and reports.
- You receive a limited right of use to use reports for internal purposes and, if you are an agency, for delivery to your end client in accordance with your plan or agreement.
- You may not reuse parts of reports as a template or basis for other clients, or create works that are substantially based on the structure of the reports.
9. Liability and limitations
- Kaistone makes no warranties that results are always accurate or complete.
- Kaistone is not liable for indirect damages such as lost profit or lost revenue.
- Kaistone's liability is limited to the extent required by mandatory law, and may also be regulated in a separate agreement.
10. Support and operations
Kaistone strives for good availability and stable operations. We respond to support matters within 48 hours on business days. Kaistone may introduce service levels in a separate appendix or separate agreement as the service develops.
11. Amendments
- Kaistone may update the features and content of the service over time.
- Kaistone may update these terms and will then publish a new version on the website.
- If you continue to use the service after the terms have been updated, you are deemed to have accepted the change.
12. Termination
- If you have a subscription, the notice period applies in accordance with the quote, price list, or separate agreement.
- Kaistone may suspend access in the event of late payment or suspected misuse.
- In the event of material breach of contract, Kaistone may terminate the agreement with immediate effect.
13. Personal data and cookies
When you use the website, Kaistone may process personal data, for example in connection with contact, support, or invoicing. Read more in our Privacy Policy and Cookie Policy.
14. Governing law and disputes
- Swedish law applies.
- Disputes should first be resolved through negotiation.
- If not resolved, disputes will be settled by Uppsala District Court unless mandatory law or a separate agreement provides otherwise.
